Welcome to SouthIndianMarriage.com. These Terms and Conditions govern your use of the website www.southindianmarriage.com (the "Website") and the services provided by SouthIndianMarriage (SIM). By accessing or using the Website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website.

Electronic Record

This document is an electronic record under the Information Technology Act, 2000 and applicable rules, as amended. It is generated by a computer system and does not require physical or digital signatures. It complies with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021.

Scope

SIM operates as an "Intermediary" under Section 2(1)(w) of the Information Technology Act, 2000. It provides a platform for users to register, create profiles, and search for lawful matrimonial alliances. Profiles are categorized by language and region for convenience. Members can search profiles based on partner preferences and shortlist prospects. SIM’s WhatsApp service may assist in profile creation, requiring a valid mobile number and email address.

1. Eligibility

A) SIM membership is reserved for:

  • Persons of Indian Origin (PIO).
  • Indian Nationals & Citizens.
  • Persons of Indian Descent or Indian Heritage.
  • Non-Resident Indians (NRI).
  • Persons intending to marry persons of Indian Origin.

B) As a SIM member, you confirm:

  • You are 18 or above (women) or 21 or above (men).
  • If residing outside India, you are legally competent to marry under local laws and will comply with Indian laws for marrying a person of Indian Origin.
  • If awaiting divorce, you may register by stating "Awaiting Divorce".

C) If registering on behalf of a prospective bride or groom, you confirm their consent for profile creation and platform access.

2. Registration

A) Complete the registration process honestly, providing true, accurate, current, and complete information, including recent photographs. Do not enter inappropriate details or unrelated photos. SIM may request additional information to enhance services, which you agree to provide.

You may contact our retail outlets or respond to registration campaigns, and our Customer Service Center will assist with registration. SIM may reproduce your profile (excluding mobile number and email) on other SIM-owned matrimonial websites for better matching.

B) If SIM finds any provided information to be untrue, inaccurate, or incomplete, it may suspend or terminate your membership without notice, forfeiting any fees paid.

C) SIM may block profiles with inappropriate contact details or inconsistent information.

D) Duplicate profiles for the same individual are prohibited, and SIM may suspend or terminate such profiles.

E) Registration and use of SIM services are for seeking marriage only. Commercial use by organizations or competing services is prohibited, and SIM may take legal action for breaches.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials (user ID, password, OTP) and restricting device access. SIM will not request your password, and you should not share it. You are liable for all activities under your account.

4. Role and Responsibility of SouthIndianMarriage

A) SIM displays your profile "as-is" and shares it with other members across KANNAN & SONS TRUST-owned websites. B) SIM provides an interface for independent profile searches without direct assistance. C) Matches are generated based on your partner preferences, which may change if preferences are updated. D) SIM allows members to express interest in profiles, but you may accept or decline based on your preferences. E) SIM does not guarantee specific outcomes from its services. F) SIM implements security standards, authentication, access controls, and encryption to safeguard user information. G) SIM cannot guarantee complete protection from third-party tampering during data transmission. H) SIM does not authenticate or endorse profile information; you must verify other users’ credentials.

5. Role and Responsibility of SIM Member

A) Create a strong password using uppercase, lowercase, and numbers. B) Provide requested information promptly. C) Verify prospective matches’ credentials (marital status, education, etc.) before proceeding. SIM is not liable for inaccuracies. D) SIM is not responsible for misconduct during video calls. Refer to the "Safe SouthIndianMarriage" link for guidance. E) Upload recent photos (within 3 months). Outdated or false information violates terms, and SIM may act per clause 2(b). F) Disclose health status, including medical conditions or disabilities, during enrollment. Non-disclosure violates terms. G) Refrain from:

  • Financial transactions with prospects.
  • Abusive or inappropriate language.
  • Discriminatory or racial comments.
  • Sharing confidential information (e.g., bank details).
  • Physical relationships before marriage.
  • Violating laws.
  • Referencing other matrimonial services in messages.

H) Visit https://www.southindianmarriage.com/ for safety measures. I) Be cautious of prospects who request favors, use multiple numbers, avoid meetings, or have suspended profiles. J) Log in regularly to optimize search results and send interest messages. K) Adhere to terms for features like chatting, viewing horoscopes, privacy settings, and social profiles. L) Update profile changes, or SIM may suspend membership. M) Delete your profile or inform SIM upon marriage finalization. N) Use secure devices and networks. O) Do not use bots or automated scripts. P) Do not probe or breach SIM’s security measures. Q) Make payments only to SIM’s official account, not employees’ personal accounts. R) Address complaints to KANNAN & SONS TRUST, not social media.

7. Medium of Communication

A) By registering, you consent to communications (e.g., emails, calls, SMS, WhatsApp) from KANNAN & SONS TRUST or partners. B) SIM’s system sends profile information. By providing your number, you confirm it is not on DND/NCPR and agree not to complain about communications. C) Customize communication frequency or opt out of calls, but you may receive calls from Relationship Managers if shortlisted.

8. Confidentiality

Feedback provided to SIM is non-confidential and may be used without restrictions. You warrant that feedback contains no confidential or proprietary information, SIM has no confidentiality obligation, and you are not entitled to compensation.

10. Grievance Cell

Report violations (e.g., obscene content, impersonation) to:

Grievance office hours: 10 AM–6 PM IST, Monday–Saturday, excluding Sundays and public holidays. Complaints must be in writing.
Users must not share information that:

  • Belongs to others without rights.
  • Is obscene, pornographic, or offensive.
  • Harms children.
  • Infringes intellectual property.
  • Misleads or impersonates.
  • Threatens India’s security or public order.
  • Contains viruses.
  • Violates laws.

11. Disputes between Members

A) Members are responsible for communications with prospects. SIM is not liable for transactions or interactions. B) SIM does not monitor or mediate disputes. C) SIM is not a broker and does not participate in member discussions.

12. Content Right

A) SIM content belongs to KANNAN & SONS TRUST, except user or third-party content with licenses. B) You are responsible for your profile content and grant SIM a worldwide, non-exclusive, royalty-free license to use it. C) SIM may delete violating content or suspend/terminate profiles without refunds. KANNAN & SONS TRUST may take legal action against proprietary rights violations.

13. Third Party Website

A) Third-party ads are not controlled by SIM and are subject to their own terms. B) SIM may offer third-party services (e.g., horoscope matching) but is not liable for them. C) SIM may modify services without notice.

14. Limitation of Liability

A) SIM is not liable for direct, indirect, or consequential damages from Website or third-party service use. B) Profile exchanges are not matrimonial offers or guarantees. C) SIM’s liability is limited to the amount paid for a specific package. 15. SIM is not liable for incorrect matches due to profile unavailability. 16. SIM is not liable for financial transactions between members or third parties. 17. SIM is not liable if a member does not respond to a matrimonial approach.

18. Class Action Suits

You agree not to participate in class actions or class arbitration against SIM.

19. General

Filing false complaints may lead to legal action and profile suspension, with forfeiture of fees per clause 2(b).

24. Disclaimer

A) SIM services are provided "as is" without warranties. SIM is not liable for damages from Website use. B) Registration does not guarantee marriage. C) SIM is not responsible for:

  • Incorrect information submitted.
  • Decisions based on user information.
  • Unauthorized third-party acts.
  • Cybercrimes.
  • Force majeure events.
  • Third-party services.
  • Interaction outcomes.
  • Technical malfunctions.

D) Website use is at your own risk. E) SIM is not liable for equipment damage from app use.

25. Indemnity

You agree to indemnify SIM and its affiliates from losses due to improper use of services.

26. Termination

A) SIM may terminate or suspend your membership for seeking favors, providing false information, illegal activities, violating terms, or impersonation. B) SIM is not liable for losses from suspensions due to complaints. C) Membership may be terminated with 7 days’ notice, forfeiting paid amounts. D) Termination ends access, but surviving terms (e.g., liability) remain.

27. Jurisdiction and Applicable Law

A) SIM services are entered into in Chennai, India. B) Disputes are governed by Indian laws and subject to Chennai courts.

28. Mode of Payment

A) Payments via UPI/Net Banking follow RBI guidelines.

29. Refund and Assignment

A) Donation payments to KANNAN & SONS TRUST are non-refundable.

30. Non-Resident Indian Terms

A) Indian laws apply. B) Intellectual property disputes may be resolved outside arbitration. C) Arbitration enforcement proceedings may be brought in Chennai courts.

34. Membership Packages

A) SIM offers Free and Premium memberships. B) Usage limits for personal messages:

35. WhatsApp Services

Services: SIM’s WhatsApp service assists with profile registration. Agents guide customers on using the Website/App.
Eligibility: Indian citizens above 18 in Chennai, India.
Booking: Contact via WhatsApp (9750220204), provide name, mobile, and email, and pay Rs. 99 via UPI. Service starts within 7 working days.
Roles & Responsibility of SIM:

  • Assists with profile registration.
  • Implements security standards.
  • Cannot guarantee data protection during transit.
  • Not responsible for delays due to Force Majeure.
  • Not liable for transactions with representatives; payments must go to SIM’s account.

Roles & Responsibility of Customer:

  • No discrimination against agents.
  • Treat agents respectfully, or services may be denied.
  • No financial transactions with representatives.

Complaints: Contact customer support at info@southindianmarriage.com or infosouthindianmarriage@gmail.com. Grievance office hours: 10 AM–6 PM IST, Monday–Saturday. Complaints must be in writing.
Indemnity: You indemnify SIM from losses due to improper service use.
Termination: SIM may terminate services for breaches. Surviving terms remain.
Governing Laws: Indian laws apply.
Arbitration: Disputes unresolved within 30 days go to arbitration in Chennai under The Arbitration and Conciliation Act, 1996, in English.
